Terms and Conditions
1. The Service
The Lead Caller ("we", "us", "our") provides a voice AI platform that places automated outbound phone calls to leads and contacts uploaded by the tenant ("you", "the customer") in order to qualify, inform, or follow up with those contacts. The Service includes agent configuration, call orchestration, recording, transcription, and reporting.
2. Your Leads and Contact Data
You are solely responsible for the leads, contacts, and any other data you upload to the Service, including obtaining any consents required by applicable law to contact those individuals by phone. You represent and warrant that you have the legal right to share this data with us and to authorize automated calls to it.
3. Call Recording and Transcription
Calls placed through the Service may be recorded and transcribed using artificial intelligence, for quality assurance, dispute resolution, and to generate the reports made available to you. By using the Service, you consent to this recording and transcription, and you are responsible for providing any notice or obtaining any consent legally required in your jurisdiction before calls are placed to call recipients.
4. Data Retention
We retain lead data, call recordings, and transcripts for as long as your account remains active, plus a reasonable period thereafter, or as required by applicable law. You may request deletion of your data, subject to legal and operational retention requirements.
5. Billing
The Service is billed on a prepaid wallet basis: you load funds into your account in advance, and usage (call minutes and related fees) is deducted from your balance as it is consumed. Purchases and wallet top-ups are non-refundable, except where required by law or expressly stated otherwise by us.
6. Limitation of Liability
To the maximum extent permitted by law, The Lead Caller shall not be liable for indirect, incidental, special, or consequential damages arising from use of the Service, including but not limited to lost profits, lost leads, or business interruption. Our total aggregate liability shall not exceed the amount you paid us in the three (3) months preceding the claim.
7. Governing Law
